3. hosting & server log files
this website is hosted by strato ag, otto-ostrowski-straße 7, 10249 berlin, germany. when you visit this site, the hosting provider automatically collects and stores technical data in server log files (including ip address, browser type, operating system, referrer url and timestamp). this data is processed pursuant to art. 6 (1) (f) gdpr based on our legitimate interest in maintaining the technical stability and security of our website. we have entered into a data processing agreement (dpa) pursuant to art. 28 gdpr with strato.
the fonts used on this website are hosted on our own server. no connection to google or other font providers is established.
4. ssl/tls encryption
this site uses ssl/tls encryption for security reasons and to protect the transmission of confidential content. you can recognize an encrypted connection by the browser’s address bar.
5. cookies & consent
cookies are small text files stored on your device. we only use cookies that require consent (analytics and marketing, see below) after you have actively clicked “accept” in our cookie banner. the corresponding scripts are technically blocked until consent is given. your choice is stored locally in your browser. you can change or revoke your decision at any time via the “manage cookies” link in the footer of this website (art. 6 (1) (a) gdpr, § 25 (1) ttdsg). refusing consent does not limit the core functionality of this site.
6. google analytics 4
with your consent, we use google analytics 4, a web analytics service provided by google ireland limited, gordon house, barrow street, dublin 4, ireland. google analytics uses cookies and similar technologies to analyze how visitors use the site. we also measure sign-ups (only the form used) and purchases of digital products (order value, currency and order number). ip addresses are processed with ip anonymization. data may be transferred to google llc in the usa; this transfer is safeguarded by the eu-us data privacy framework and standard contractual clauses. legal basis: your consent pursuant to art. 6 (1) (a) gdpr. you can revoke your consent at any time via “manage cookies”. details: policies.google.com/privacy.
7. meta pixel
with your consent, we use the meta pixel provided by meta platforms ireland limited, merrion road, dublin 4, ireland. the pixel allows us to measure the effectiveness of ads and show interest-based advertising on facebook and instagram. data (e.g. your ip address, browser information and page interactions) may be transferred to meta platforms inc. in the usa, safeguarded by the eu-us data privacy framework and standard contractual clauses. meta may link this data to your facebook/instagram account. we measure the following events: page views, sign-ups to the newsletter or a waitlist (only the form used, e.g. “guides” or “shop”) and purchases of digital products (order value, currency and an order number). if the advanced matching feature of the meta pixel is active, contact details you enter in a form on this site (in particular your email address) are converted into a hashed value (sha-256) in your browser before transmission, so meta only receives this hash and uses it to match the event to an existing meta account; the plain email address is not transmitted to meta through the pixel. legal basis: your consent pursuant to art. 6 (1) (a) gdpr, revocable at any time via “manage cookies”. details: facebook.com/privacy/policy.
8. newsletter (brevo)
we run two newsletters: the alapfy concrete school newsletter (all 4 starter guides, course news, vouchers, offers, new guides and learning material) and the alapfy concrete shop newsletter (shop launch, new products, vouchers and offers). both are subscribed together with one consent: whichever form you use, you receive both newsletters. we process your email address and the language of the page you signed up on to send them to you. you receive personal voucher codes, which we store with your contact. the unsubscribe link in our emails ends both newsletters at once.
additional information: in our sign-up forms we ask whether you are a beginner or a pro and whether you sign up as a business or privately, so we can send you content that fits you. you can also voluntarily tell us whether you are interested in a concrete community (waitlist) and leave a message or product request (shop). we also store which form you used (e.g. guide, course notification, shop, community, instagram). we use this information only to send you more relevant content and to plan new offers. you can change it anytime via the links in our emails or by writing to us.
proof of consent: to document your consent, we additionally keep a log on our server with the time, email address, form used and the consents given. we keep this log for as long as you are subscribed and up to 3 years afterwards.
double opt-in and logging: subscription takes place via a secure double opt-in process. after entering your email address, you will receive a confirmation email containing a link. your subscription only becomes active once this link is clicked. to comply with legal documentation requirements, we log your subscription (ip address, timestamp of initial sign-up and timestamp of confirmation).
legal basis: your express consent pursuant to art. 6 (1) (a) gdpr.
dispatch provider: the newsletter is sent using brevo, a service provided by sendinblue sas, 106 boulevard haussmann, 75008 paris, france. your email address and logging data are stored on brevo’s servers within the european union. we have entered into a data processing agreement (dpa) pursuant to art. 28 gdpr with brevo.
performance tracking (web beacon): our newsletters contain a miniature tracking pixel. when you open an email, technical data (browser type, ip address, time of retrieval and clicked links) is collected. this data is used exclusively for the statistical analysis of our campaigns. by subscribing, you consent to this tracking.
revocation and unsubscription: you can revoke your consent and unsubscribe at any time via the unsubscribe link at the bottom of every newsletter email or by writing to contact@martonalapfy.com. upon unsubscribing, your email address will be deleted from the active distribution list immediately.
8a. whatsapp (optional)
if you tick the separate whatsapp checkbox and enter your mobile number, we would like to send you new courses, restocks and deals via whatsapp, no more than 1 to 2 messages a month. this consent is separate from the newsletter and voluntary. messages are sent via brevo using the whatsapp business platform of whatsapp ireland limited, merrion road, dublin 4, ireland (meta); meta may process your number and message metadata, also in the usa (eu-us data privacy framework, standard contractual clauses). legal basis: your consent pursuant to art. 6 (1) (a) gdpr. you can revoke it at any time by replying “stop” or by writing to contact@martonalapfy.com; we then delete your number.
photo feedback for course buyers: if you bought a course and send us photos of your piece via whatsapp for the included photo feedback, we process your number, the photos and our chat only to give you that feedback. this is part of the service you bought (art. 6 (1) (b) gdpr) and not advertising.
9. purchases & payment
this website does not process payments itself.
digital products (guides & courses): payments are processed by stripe (stripe payments europe, ltd., 1 grand canal street lower, dublin 2, ireland). where stripe acts as merchant of record (stripe managed payments), stripe is the seller of the digital product and processes payment, order and tax data under its own responsibility. when you click a purchase button, you are taken to a checkout page hosted by stripe; see stripe.com/privacy. after payment you return to our download page, which retrieves the payment status of your order from stripe to verify the purchase. to deliver your purchase and prevent misuse, we log on our server when your download link is opened and which files are downloaded, together with your email address, the order reference and the amount paid. we keep this log for up to 24 months.
physical products (materials): our material shop is not open yet. if you request a product or leave a wish, your email address and message are stored in our shop newsletter list at brevo (see the newsletter section).
appointments (1:1 calls): calls are booked via cal.com (cal.com, inc., usa), which opens in a new tab. when you book, cal.com processes your name, email address, your message and the appointment details; the payment is processed by stripe. see cal.com/privacy.
guide library: when you open the guide download page, we check via the brevo api whether the email address you entered is subscribed to our school newsletter. to prevent misuse, we log on our server when the library is opened and which files are downloaded, together with your email address. we keep this log for up to 24 months.
newsletter contact details: if your email address is already in our newsletter, we additionally note in your brevo contact the date of your first guide download and, after a purchase, the product, the date and any voucher code you used. we use this only to send you suitable newsletter content and reminders (e.g. not reminding you of a voucher you have already used). legal basis: your newsletter consent (art. 6 (1) (a) gdpr) and our legitimate interest in relevant, non-repetitive emails (art. 6 (1) (f) gdpr). these details are deleted together with your contact when you unsubscribe.
meta pixel advanced matching: if you consent to marketing cookies, the meta pixel may additionally transmit hashed (pseudonymised) contact information that you enter on this website, such as your email address, to improve ad measurement.
9a. reviews
on martonalapfy.com/review/ you can rate our guides and courses. we process your star rating, your comment, the name you choose to be shown with (your name or your instagram name), any photos you upload and your email address. your email address is never published; we use it to check that the review comes from someone who received our guides or bought from us, and we store your rating in your brevo contact. if you choose your instagram name, it is shown with a link to your instagram profile, only with your separate consent. photos are converted on our server into a new image file (this removes metadata such as location data) and stored on our server only. your review and each photo are published only after we have checked them, and only with your consent. legal basis: your consent pursuant to art. 6 (1) (a) gdpr. you can revoke it at any time by writing to contact@martonalapfy.com; we then remove your review and your photos.
verified reviews: we only publish reviews from people whose email address is known to us from our newsletter, our early-tester list or a purchase; they are marked “verified reader”. we do not remove a review because of its rating, only spam, insults or personal data of others. reviews from early testers, who tried the guides before the official launch, are marked “early tester”.
10. external links
this site contains links to external websites (e.g. instagram and amazon). when you click these links, the respective provider becomes responsible for the processing of your data. some amazon links are affiliate links; if you make a purchase, we receive a small commission at no extra cost to you.
11. rights of the user
you have the right to request information about your stored data, as well as the right to correction, deletion, restriction of processing, data portability and objection to processing based on legitimate interests, at any time.
12. right to lodge a complaint
in the event of violations of the gdpr, you have the right to lodge a complaint with a competent supervisory authority, for example the bavarian data protection authority (baylda).
refund policy
digital products (guides, pdfs and courses) are sold via stripe managed payments. the seller of these products is stripe (link), and its terms of sale, including its rules on refunds and your statutory rights, apply to these purchases. they are shown and linked at checkout.
if a file is defective or cannot be accessed, just write to contact@martonalapfy.com and we will send you a working copy right away.
physical products (materials) will be sold directly on this website once the shop opens; the terms and withdrawal information shown there will apply.
